These Terms of Use govern your access to and use of www.heartsforthehungry.org, including its pages, content, forms, donation features, email subscriptions, and related online services. The website is operated by Hearts For The Hungry, Inc., publicly known as Hearts for the Hungry. In these Terms, “Hearts for the Hungry,” “we,” “us,” and “our” refer to Hearts For The Hungry, Inc.

By accessing or using this website, you agree to these Terms. If you do not agree, please discontinue use of the website.

1. About Hearts for the Hungry

Hearts For The Hungry, Inc. is a Pennsylvania nonprofit corporation recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code.

Our mission is to serve vulnerable children, families, schools, churches, and communities in Haiti through food support, educational assistance, emergency relief, trusted local partnerships, and practical care.

This website provides information about our mission, programs, partners, stories, donation opportunities, and ways to become involved.

2. Eligibility

You must be at least 18 years old to make a donation or enter into a financial transaction through this website. A person under 18 may use the website only with the involvement and permission of a parent or legal guardian.

By making a donation, you represent that:

You are legally authorized to use the payment method submitted.
The information you provide is accurate.
You understand and authorize the donation amount and frequency selected.

3. Acceptable Use

You may use this website only for lawful purposes.

You may not:

Violate any applicable law or regulation.
Attempt to gain unauthorized access to the website, accounts, systems, networks, or data.
Interfere with the operation or security of the website.
Introduce viruses, malicious code, automated attacks, spam, or harmful material.
Use automated tools to scrape, copy, extract, or reproduce website content without authorization.
Submit false, misleading, unlawful, threatening, abusive, defamatory, or infringing material.
Misrepresent your identity or relationship with Hearts for the Hungry.
Use our content, name, logo, or branding in a manner that suggests an unauthorized endorsement, affiliation, sponsorship, or partnership.
Use the website in a manner that violates another person’s privacy, safety, intellectual property, or other legal rights.

We may restrict or discontinue access when we reasonably believe these Terms have been violated or when access presents a security or operational risk.

 

4. Website Content

The information on this website is provided for general informational, charitable, religious, and ministry purposes.

We make reasonable efforts to keep the information accurate and current. However, we do not guarantee that all content will always be complete, current, accurate, or error-free.

Program descriptions, donation needs, costs, statistics, photographs, stories, partnerships, events, schedules, and areas of need may change without notice.

Nothing on this website constitutes legal, tax, accounting, medical, financial, or other professional advice.

5. Donations

General donations

Donations may be made through this website or through an approved third-party donation or payment service.

By submitting a donation, you confirm that:

The information you provide is accurate.
You are authorized to use the selected payment method.
You authorize the amount shown before checkout.
If you select a recurring donation, you authorize the selected amount to be charged at the stated frequency until canceled.
You have reviewed the transaction information before submitting payment.

Use and control of donated funds

Hearts For The Hungry, Inc. maintains exclusive legal control and discretion over all donated funds and will use donations in furtherance of its charitable mission.

Unless Hearts For The Hungry, Inc. expressly agrees in writing to accept a legally restricted gift, any program, project, location, school, ministry, family, individual, or purpose identified by a donor will be treated as an expression of the donor’s charitable preference and not as a binding legal restriction.

We will make reasonable efforts to honor donor preferences. However, if a project or stated purpose is fully funded, completed, delayed, discontinued, impracticable, no longer consistent with current conditions or needs, or affected by an emergency or other circumstances beyond our control, we may use the donation for a similar charitable purpose or where it is most needed within our mission.

6. Payment Processing

Online donations may be processed through Wix and payment-service providers made available through or integrated with the website.

Payment providers operate under their own terms, privacy notices, security practices, and processing procedures.

Hearts for the Hungry is not responsible for a payment provider’s independent service interruptions, processing delays, account restrictions, technical failures, security practices, fees, or privacy practices. This limitation does not affect legal rights that cannot be waived.

Donation refunds

Charitable donations are generally final.

Please contact us promptly if:

A donation was submitted accidentally.
A transaction was duplicated.
An incorrect amount was charged.
A recurring donation was processed after a timely cancellation request.
You believe a transaction was unauthorized.

Refund requests will be reviewed individually. Approval may depend on the circumstances of the request, the amount of time that has passed, payment-processor requirements, transaction status, applicable fees, and whether the funds have already been committed or spent for charitable purposes.

Recurring donations

When you select a weekly, monthly, yearly, or other recurring donation, you authorize the donation amount shown to be charged at the frequency selected until the recurring donation is canceled.

You may cancel or change a recurring donation through the applicable donation platform, when that option is available, or by contacting info@heartsforthehungry.org.

Please submit cancellation requests before the next scheduled charge and allow reasonable time for processing. A charge that has already entered processing may not be preventable. Canceling a recurring donation does not automatically refund donations that were previously processed.

Transaction-fee contributions

The donation form may allow you to voluntarily add an amount intended to help offset payment-processing costs.

Selecting this option is voluntary. The total amount to be charged should be displayed before you submit the donation.

Any amount added to offset processing costs will be treated as part of your charitable contribution and will be used in support of our charitable operations.

 

Donation acknowledgments and tax information

Hearts for the Hungry will provide an electronic or written acknowledgment for online donations.

When applicable, the acknowledgment will identify Hearts For The Hungry, Inc. as the recipient organization; the contribution date; the amount of a monetary contribution; a description, but not the value, of a noncash contribution; and whether any goods or services were provided in exchange for the contribution.

Unless expressly stated otherwise, no goods or services are provided in exchange for a donation.

If goods or services are provided in exchange for a contribution, the acknowledgment may describe those goods or services and provide a good-faith estimate of their value as required by applicable law.

Contributions are tax-deductible only to the extent permitted by law. Donors are responsible for retaining their records and consulting their own tax, legal, accounting, or financial advisors.

7. Messages, Dedications, Prayer Requests, and Special Instructions

The donation form may allow you to submit a message, dedication, prayer request, or special instruction.

Please do not include:

Social Security numbers.
Complete bank- or payment-card information.
Passwords or login credentials.
Detailed medical records.
Government identification numbers.
Confidential information about another person without permission.
Information that could place a child or vulnerable person at risk.

By submitting information about another person, you represent that you have permission to provide it.

Prayer requests and messages may be reviewed by authorized staff members or volunteers for purposes such as responding to your communication, praying for the stated need, administering a donation, following special instructions, or addressing the purpose for which the information was submitted.

We will not intentionally publish a private prayer request or sensitive personal message without appropriate permission.

8. Email Signups and Communications

You may voluntarily subscribe to newsletters, ministry updates, prayer updates, impact stories, fundraising communications, and similar messages.

You may unsubscribe from general email communications at any time by using the unsubscribe link in an email or contacting info@heartsforthehungry.org.

Even after unsubscribing from general communications, you may still receive necessary transactional or administrative messages, including donation receipts, recurring-donation notices, responses to inquiries, security or account-related notices, and legally required communications.

We cannot guarantee delivery of every email. Delivery may be affected by spam filters, email-provider settings, technical outages, or inaccurate contact information.

9. Contact Forms and User Submissions

Information submitted through a contact form, donation form, newsletter signup, volunteer form, or other website feature must be accurate and lawful.

You may not submit material that is false or misleading, unlawful, threatening, abusive, defamatory, infringing, malicious, confidential without authorization, or harmful to a child or vulnerable person.

By submitting a question, prayer request, testimonial, photograph, story, comment, or other material, you give Hearts for the Hungry permission to receive, review, store, and respond to that material for the purpose for which it was submitted.

Submitting material does not automatically give us permission to publish it publicly. We will seek appropriate permission before publicly using a private testimonial, personal story, identifiable photograph, or other personal submission unless the submission process clearly states that publication is intended and you expressly agree to that use.

Personal information will be handled in accordance with our Privacy Policy.

10. Photographs, Videos, and Personal Stories

The website may contain photographs, videos, stories, testimonials, program information, and impact information involving children, families, schools, communities, donors, volunteers, and ministry partners.

We seek to use these materials respectfully and in a manner intended to protect personal dignity, safety, and privacy.

Appropriate permission should be obtained before identifiable photographs, videos, or private personal stories are published.

We seek to avoid publishing unnecessary identifying information concerning children or vulnerable individuals.

Contact info@heartsforthehungry.org if you believe a photograph, name, story, video, or identifying detail should be reviewed, corrected, or removed.

We will review reasonable requests and take appropriate action based on the circumstances, available consent records, safety considerations, historical documentation, and applicable law.

11. Programs, Conditions in Haiti, and Impact Information

Program descriptions, costs, statistics, anticipated results, delivery schedules, and areas of need are provided in good faith based on information available when published.

Conditions in Haiti may change because of emergencies or natural disasters; political or civil instability; security concerns; transportation interruptions; customs or import restrictions; supply limitations; currency changes; local partner capacity; weather; funding levels; or other circumstances outside our control.

We do not guarantee that a particular donation will produce a specific result, reach a specific recipient, be delivered by a particular date, or support a project in precisely the manner originally anticipated.

We will nevertheless use reasonable charitable judgment to advance our mission and steward donations responsibly.

12. Partner Organizations

This website may identify churches, schools, ministries, nonprofit organizations, suppliers, transportation providers, community leaders, and other organizations with which Hearts for the Hungry works.

Unless expressly stated otherwise, these organizations are legally independent.

Reference to a partner does not mean Hearts for the Hungry owns the partner, controls all of its operations, supervises every activity, endorses every statement or policy, or assumes responsibility for all of its actions, decisions, debts, or obligations.

Each partner is responsible for its own independent operations and legal obligations.

13. Intellectual Property

Unless otherwise identified, website text, graphics, logos, photographs, videos, designs, page layouts, and other content are owned by Hearts For The Hungry, Inc. or used with permission.

You may:

Share links to publicly available website pages.
Share unaltered ministry updates for personal, church, educational, or charitable purposes.
Print reasonable portions of the website for personal and noncommercial use.

You may not, without prior written permission:

Sell or commercially exploit website content.
Reproduce substantial portions of the website.
Alter content in a misleading manner.
Remove copyright, credit, or ownership notices.
Use photographs of children or beneficiaries outside their intended context.
Use the Hearts for the Hungry name, logo, or branding to imply an unauthorized endorsement or affiliation.
Use website material in a manner that infringes another person’s rights.

14. Third-Party Services and Links

The website may use or link to third-party services for website hosting, donation processing, payment processing, email communications, analytics, embedded media, social-media features, forms, security, and other functions.

Third-party services are governed by their own terms and privacy notices.

Hearts for the Hungry is not responsible for the independent availability, content, security, accuracy, privacy practices, or operation of a third-party website or service.

A link or reference does not necessarily constitute endorsement.

You access independent third-party services at your own risk, subject to any rights provided by applicable law.

15. Privacy

Our Privacy Policy explains how Hearts for the Hungry collects, uses, discloses, retains, and protects personal information.

The Privacy Policy is incorporated into these Terms by reference.

However, we do not guarantee uninterrupted access or that the website will always be free from errors, delays, viruses, harmful components, technical failures, security incidents, or unauthorized access.

The website may be unavailable because of maintenance, updates, provider outages, security concerns, or circumstances beyond our control.

We may update, suspend, remove, or discontinue website content or features without notice.

Nothing in these Terms limits liability for conduct or damages that cannot legally be limited or excluded.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Hearts For The Hungry, Inc. and its directors, officers, employees, volunteers, and representatives from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the website, your material violation of these Terms, or your infringement or violation of another person’s legal rights.

21. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms or use of the website must be brought in a court of competent jurisdiction located in or serving Erie County, Pennsylvania, unless applicable law requires another location.

22. Pennsylvania Charitable-Solicitation Disclosure

The official registration and financial information of Hearts For The Hungry, Inc. may be obtained from the Pennsylvania Department of State by calling toll-free, within Pennsylvania, 1-800-732-0999. Registration does not imply endorsement.

23. Changes to These Terms

We may revise these Terms periodically to reflect changes in our website, programs, services, technology, or legal obligations.

The revised Terms will be posted on this page with an updated effective date.

Changes apply prospectively unless applicable law requires otherwise.

24. Severability and Waiver

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
